California's labor laws protect all employees, regardless of age, assuring everyone the right to fair wages for fair work. The Legislature has determined what a minimum wage should be, and applies this minimum wage across the board. There is no such thing as a "less than minimum wage" for teenager workers, for example.

Is Your Employer Paying Less than Minimum Wage by Making You Work Off the Clock?

Some employers claim to pay minimum wage — yet they require employees to work without pay, or fail to pay overtime as required for more than 8 hours a day. Failure to compensate you for driving time from one job site to another, or for set-up and clean-up at construction sites, may result in a situation where you are, in essence, earning less than minimum wage, all told.

 

Drive Time Between Job Sites Should Be Paid

Employment contracts can spell out different pay rates for different types of work — for example, minimum wage for drive time between job sites and a higher wage for skilled construction labor. But the employer may not require work without pay or pay less than minimum wage for unskilled work such as cleaning up shopping carts from the parking lot at the end of a workday.

 

What If You Are Often Sent Home Early?

You may suspect that your pay is unfair if you are asked to show up for an 8-hour day and are then sent home after less than one hour, with only one hour's pay or with no pay at all. Or you may wonder whether your employer is in essence paying less than minimum wage by having you be "on call" for hours on end at home with no compensation.
